These Terms of Use ("Terms") are a binding agreement between you and Movementienergyo.ddd ("Company," "we," "us," "our") governing access to the QuickPulse website at https://movementienergyo.world/ (the "Site"). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Nature of content — not medical advice

QuickPulse provides general lifestyle and educational information about short, equipment-free workouts, including fitness, yoga, and bodyweight movement. Content is for informational and educational purposes only and is not professional medical, physical therapy, nutritional, or mental health advice. The Site does not create a coach-client, doctor-patient, or other professional relationship.

You are solely responsible for determining whether any activity is appropriate for your health and abilities. Consult a qualified healthcare or fitness professional before starting a new exercise program, especially if you are pregnant, postpartum, managing a chronic condition, or recovering from injury. Stop any activity if you feel pain, dizziness, or discomfort.

Statements on the Site have not been evaluated by the U.S. Food and Drug Administration (FDA). Content is not intended to diagnose, treat, cure, or prevent any disease or condition.

3. Eligibility and COPPA

The Site is intended for users who are at least 13 years of age. If you are under 13, you may not use the Site. If you are between 13 and 17 (or the age of majority in your state), you may use the Site only with permission of a parent or legal guardian who accepts these Terms on your behalf. By using the Site, you represent that you meet these requirements.

6. DMCA copyright policy

We respect intellectual property rights. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

Physical exercise involves inherent risks of injury. You assume full responsibility for your participation in any activities described on the Site.

Some jurisdictions do not allow exclusion of implied warranties; in those jurisdictions, disclaimers apply to the maximum extent permitted.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOVEMENTIENERGYO.WORLD, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some states do not allow limitation of certain damages; in those states, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Movementienergyo.ddd and its personnel from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, violation of any law or third-party rights, or any activity you engage in based on Site content.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Tennessee and applicable federal laws of the United States, without regard to conflict-of-law rules that would apply another state's laws.

Except where prohibited by consumer protection laws in your state of residence, you agree that exclusive jurisdiction and venue for disputes arising from these Terms or the Site shall lie in the state or federal courts located in Davidson County, Tennessee, and you consent to personal jurisdiction in those courts.

Before filing a claim, you agree to contact us at partners@movementienergyo.world to attempt informal resolution for at least thirty (30) days.

13. Modifications and termination

We may modify these Terms at any time by posting an updated version with a revised "Last updated" date. Material changes may be noted on the Site. Continued use after changes become effective constitutes acceptance where permitted by law.

We may suspend or terminate the Site or your access at any time, with or without notice, for any reason, including violation of these Terms.

14. General provisions

  • Severability: If any provision is unenforceable, the remaining provisions remain in effect.
  • No waiver: Failure to enforce a provision is not a waiver of future enforcement.
  • Entire agreement: These Terms and the Privacy Policy constitute the entire agreement regarding the Site.
  • Assignment: You may not assign these Terms; we may assign them in connection with a business transfer.
